Here is the process, the tax side and how to do it from abroad.

Key takeaways

Can an NRI buy a 2 BHK in Andheri East? The rules in brief

Yes. Under FEMA, NRIs and OCI cardholders can buy residential or commercial property in India without prior approval from the RBI, and there is no limit on how many. The only exclusions are agricultural land, plantation property and farmhouses, which you can inherit but not buy.

The money trail is where most problems start. Every payment, including your home loan EMIs, has to go through an NRE, NRO or FCNR account in India or arrive as a direct remittance from a bank abroad. Cash above the threshold, traveller’s cheques and foreign currency notes are not allowed. This matters later as well, because it decides what you can send back. If you paid with foreign funds, sale proceeds can return abroad up to the amount you brought in, routed through your NRO account and within the USD 1 million a year limit, for a maximum of two residential properties. Pay any other way and the money can stay stuck in India.

Keep the bank’s remittance record for every single transfer.

You will also need a PAN, both for TDS and for any home loan.

TDS is the part NRI buyers most often get wrong. It isn’t an extra cost, since you deduct it from what you pay the seller and deposit it with the tax department. The rule depends on the seller’s status, not yours. Buy a new flat from a resident developer and you deduct 1% when the price is ₹50 lakh or more. From April 2026, under the Income-tax Act, 2025, that goes on Form 141, which replaced Form 26QB, within 30 days after the month of deduction, and no TAN is needed. A resale 2 BHK bought from another NRI works differently. TDS is then deducted at the rates in force on the seller’s gains under Section 393(2), Form 141 cannot be used, so agree the filing route with a chartered accountant. We cross-checked the Form 141 change against two 2026 tax guides, and both agree.

Buy new from a resident developer if you’re doing this remotely. The paperwork is lighter, and that counts for a lot when you can’t walk into a tax office yourself.

On a home loan, the RBI caps lending at 75% of the property value for loans above ₹75 lakh, so on a ₹2 crore flat at least ₹50 lakh comes from your own funds. The repo rate stood at 5.50% after the RBI’s 7 October 2026 review, so ask your lender for a current rate.

Buying remotely: power of attorney, registration and site checks

If you cannot be in Mumbai to register, a power of attorney lets someone sign for you. Sign it before a notary where you live, then get an apostille in Hague Convention countries or attestation at the Indian embassy or consulate elsewhere. Courier the original to India and keep a certified copy.

Once it lands, the clock starts. The PoA must be adjudicated and stamped at the Collector of Stamps within three months, and in Mumbai that office has been at the Old Custom House in Fort. A PoA in favour of a blood relative attracts ₹500 stamp duty. Give a non-relative the power to buy property and the duty can rise to conveyance level, about 5% in Mumbai. We’d name a parent or sibling where you can.

Check the project before you send a rupee. Search the MahaRERA number, the completion date and any extensions, using our guide to checking a MahaRERA registration. Ask the developer for a live video walkthrough, and have your attorney visit the site. If you are flying in for a short trip, the airport at Sahar is itself in Andheri East, so a site visit fits into a single day. Compare layouts on our 2 BHK flat page before you shortlist.

Bottom line: as an NRI, the 2 BHK itself is the easy part. Route every rupee through the right account, get TDS right for the seller you are buying from, and adjudicate your PoA on time, and the purchase works as smoothly from Dubai or London as from Mumbai.

Frequently asked questions

Yes. NRIs and OCI cardholders can buy residential property anywhere in India, including Andheri East, without prior RBI approval. They cannot buy agricultural land, plantation property or farmhouses. There is no limit on how many homes an NRI can buy.

Pay in rupees from an NRE, NRO or FCNR account, or by direct inward remittance from a bank abroad. Paying from NRE or FCNR funds, or by remittance, keeps the purchase eligible for later repatriation of sale proceeds within RBI limits.

Yes, the buyer deducts TDS whatever their residency. From a resident developer, it is 1% when the price is ₹50 lakh or more, filed on Form 141 from April 2026. Buying from an NRI seller means TDS at higher rates on their capital gains, filed through a different route.

No. A power of attorney, notarised and apostilled or attested abroad, lets a relative sign and register for you. It must be adjudicated at the Collector of Stamps in Maharashtra within three months of arriving in India.

Yes. Indian banks lend to NRIs much as they do to residents, often with video KYC. For loans above ₹75 lakh, the RBI caps lending at 75% of the property value. EMIs must be paid from an NRE or NRO account.

No. NRIs pay the same Mumbai stamp duty as residents, 6% including the 1% metro cess, or 5% for a woman buying alone. Registration is 1% of the value, capped at ₹30,000. Check current rates on IGR Maharashtra.

If you bought with foreign funds, you can repatriate up to the amount you brought in, through your NRO account, within USD 1 million per financial year, for up to two residential properties. Taxes must be cleared first.

You need a passport, PAN, OCI card if applicable, overseas address proof and NRE, NRO or FCNR account details. For a loan, add overseas income documents. If someone signs for you, add the adjudicated power of attorney.

Fact check

This guide summarises FEMA, TDS and stamp duty rules as published in sources dated May to October 2026, under the new Income-tax Act, 2025. Rules for NRIs change, and your own residency, funds and seller decide what applies, so confirm with a chartered accountant and a property lawyer before you pay or sign.
